本利用規約は、Akari Web Design（Dolce Marketing 合同会社が運営）がクライアントに提供するウェブデザインおよび関連サービスに適用されます。サービスをご利用いただくことで、本規約に同意したものとみなします。
These Terms & Conditions govern the provision of web design and related services by Akari Web Design (operated by Dolce Marketing GK). By engaging our services, you agree to these terms.
Definitions
「当社」とはAkari Web Design / Dolce Marketing 合同会社を指します。「お客様」「クライアント」とは当社のサービスをご依頼いただく個人または法人を指します。「プロジェクト」とは書面にて合意されたウェブデザインおよび関連業務を指します。
"We", "us", and "our" refer to Akari Web Design / Dolce Marketing GK. "You" and "client" refer to the individual or business engaging our services. "Project" refers to the work agreed upon in writing.
Scope of work
各プロジェクトの業務範囲（成果物、スケジュール、料金を含む）は、着手前に書面にて合意します。合意範囲外の作業については、着手前に別途見積もりおよび合意を行います。
The scope of each project will be agreed upon in writing prior to commencement. Any work outside the agreed scope will be quoted and agreed separately before additional work begins.
Payment terms
すべてのプロジェクトは、着手前に費用の50%をデポジットとしてお支払いいただきます。残りの50%はプロジェクト完了時、最終納品前にお支払いいただきます。
All projects require a 50% deposit before work commences. The remaining 50% is due upon project completion, prior to final delivery.
デポジットのお支払いが確認されるまで作業は開始しません。全額のお支払いが完了するまで最終納品（ファイルの引き渡し、サイト公開など）は行いません。
Work will not begin until the deposit has been received. Final delivery will not take place until the full balance has been paid.
請求書は特段の合意がない限り日本円（JPY）で発行され、銀行振込にてお支払いいただけます。
Invoices are issued in Japanese Yen (JPY) unless otherwise agreed, payable via bank transfer.
Revisions
各プロジェクトには、軽微な修正を2回まで無償で含みます。軽微な修正とは、承認済みコンテンツへの小規模な変更（テキスト編集、色調整、画像差し替え、レイアウトの微調整など）を指します。
Each project includes two rounds of minor revisions at no additional charge, defined as small changes to existing approved content.
以下は軽微な修正には含まれず、別途お見積りとなります：

Cancellation
作業着手後にキャンセルされた場合、デポジットは返金されません。これは、すでに投じた時間およびリソースに対する対価です。
If a client cancels a project after work has commenced, the deposit is non-refundable.
デポジット段階を超えて相当の作業が完了した後にキャンセルされた場合、残額はキャンセル時点の作業完了割合に基づいて按分請求します。作業着手前のキャンセルについては、発生した管理費用を差し引いたうえで、デポジットを返金する場合があります。
If cancellation occurs after substantial work has been completed, the remaining balance will be pro-rated. If cancellation occurs before any work has commenced, the deposit may be refunded minus administrative costs.
Intellectual property
全額のお支払い完了後、プロジェクトのために制作された最終ウェブサイトおよびそのデザイン（ファイル、コード、素材を含む）の知的財産権はクライアントに帰属します。全額支払い完了前は、制作物の知的財産権はAkari Web Design / Dolce Marketing 合同会社に帰属します。
Upon receipt of full payment, the client owns all intellectual property rights to the final website. Prior to full payment, all work produced remains the intellectual property of Akari Web Design.
クライアントから書面による申し出がない限り、完成した制作物を当社のポートフォリオおよびマーケティング素材として使用する権利を保持します。サードパーティの素材（ストック画像、フォント、プラグインなど）はそれぞれのライセンスに従います。
We retain the right to display completed work in our portfolio and marketing materials unless the client explicitly requests otherwise in writing. Third-party assets remain subject to their respective licences.
Client responsibilities
クライアントには以下の責任があります：

クライアントの都合による遅延が原因のスケジュール遅れについて、当社は責任を負いません。
We are not responsible for delays resulting from the client's failure to provide required materials.
Ongoing maintenance
継続保守サービスは、月次更新または割引料金の3ヶ月コミットメントプランでご提供します。
Ongoing maintenance services are offered on a monthly rolling basis or as a minimum 3-month commitment at a discounted rate.
いずれの当事者も、30日前の書面による通知をもって保守契約を解約できます。3ヶ月コミットメントの場合、初回3ヶ月経過後にいつでも解約通知が可能です。
Either party may terminate a maintenance agreement with 30 days written notice. For 3-month commitments, notice may be given after the initial period has elapsed.
Limitation of liability
当社は、合意した水準およびスケジュールで業務を遂行し、問題が発生した場合は速やかに対応するよう合理的な努力を行います。
We will make reasonable efforts to deliver work to the agreed standard and timeline, and to resolve any issues promptly.
以下について、当社は責任を負いません：
We are not liable for:
当社の賠償責任は、いかなる場合においても、当該プロジェクトまたはサービスに対してクライアントが支払った総額を上限とします。
Our total liability is limited to the total amount paid by the client for the relevant project or service.
Governing law
本利用規約は日本法に準拠します。本規約に関して生じた紛争は、日本の裁判所を専属的合意管轄とします。
These Terms & Conditions are governed by the laws of Japan. Disputes are subject to the exclusive jurisdiction of the courts of Japan.
Changes to these terms
当社は本利用規約をいつでも更新する権利を留保します。変更後の規約は、改訂日とともに本ページに掲載します。サービスの継続利用をもって、更新後の規約に同意したものとみなします。
We reserve the right to update these Terms & Conditions at any time. Continued use of our services constitutes acceptance of the updated terms.
